Sweepstakes and Contests

Sweepstakes, contests, games, and other promotions run on a 94.3 KILO Radio site may require the user to provide some personally identifiable information to participate such as full name, address, email address, phone number and cable system/cable channel on which the user watches 94.3 KILO Radio. Children under 13 are encouraged to ask permission and obtain consent from a parent before entering a contest. Children will be told; in easy to understand language, exactly why the information is required.

In order for a child who wins a 94.3 KILO Radio contest to receive a prize, he/she must submit a signed parental release and affidavit to 94.3 KILO Radio giving 94.3 KILO Radio to send the gift. All prizes are sent to the parents and not to the child directly.

Chat Rooms, Bulletin Boards and Submissions

94.3 KILO Radio may also obtain information from a user when he/she logs on to a chat room, posts a bulletin board, sends in an idea and a number of other activities. Once again, children are encouraged to ask a parent for permission to use any of these features of the site. Children are also encouraged to use a "screen name" or their initials instead of their real name, and no last names and/or street addresses are ever required to participate. All submissions to 94.3 KILO Radio sites become the property of 94.3 KILO Radio, and 94.3 KILO Radio is entitled to use the submissions in any manner it sees fit. However, 94.3 KILO Radio does not sell or transfer personal information about users who make such submissions to third parties.

IP Addresses

94.3 KILO Radio may collect and disclose non-personal user information (for example, IP addresses) in aggregate form. An IP address is a number given to a user by a Web server. Users Agreement and Rules of Conduct

Use and participation in 94.3 KILO Radio’s Internet site is contingent upon your acceptance of the following terms and rules. By creating an account, you accept these terms. For purposes of this agreement, "Participant" refers to you. 94.3 KILO Radio refers to 94.3 KILO Radio, its parent, subsidiary and affiliated companies.

b. Participant shall not upload, post or otherwise make available on the 94.3 KILO Radio site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of such copyright, trademark or other proprietary right.
c. Participant hereby waives any and all rights to any stories, ideas, drawings, opinions, and other creative "materials" posted to the 94.3 KILO Radio site. Participant authorizes 94.3 KILO Radio to utilize, in any manner it sees fit and for eternity, the materials posted on the site, which shall become the property of 94.3 KILO Radio. Participant releases 94.3 KILO Radio from any and all claims or liability in connection therewith, and agrees to indemnify 94.3 KILO Radio in connection therewith pursuant to the terms in paragraph 3 below. Participant agrees and acknowledges that participation in the 94.3 KILO Radio site shall not give rise to any confidential, fiduciary, implied-in-fact, implied-in-law, contractual or other special relationship between Participant and 94.3 KILO Radio (other than the contractual relationship between 94.3 KILO Radio and Participant entered into by virtue of Participant's agreement to these Rules of Conduct.)

2. Rights of 94.3 KILO Radio/Disclaimer of Liability

d. 94.3 KILO Radio is a distributor only (and not a publisher) of 94.3 KILO Radio chat room and bulletin board content, which is supplied by Participant with occasional responses from 94.3 KILO Radio. 94.3 KILO Radio shall not be responsible for policing, monitoring, or editing such content, exercises no more editorial control over such content than would a public library, bookstore, newsstand, or other distributor of content, and accordingly, shall not be responsible for exercising editorial control over such content. Notwithstanding the foregoing, 94.3 KILO Radio shall have the right, but no the obligation, to monitor such content in order to respond to or comment upon communications by Participants and in order to determine compliance with the Rules of Conduct. 94.3 KILO Radio shall have the right and sole discretion to edit, to refuse to port or to remove any content whatsoever which it finds to be in violation of the provisions hereof or which it finds in its sole discretion to be otherwise objectionable for any reason. The opinions expressed in the chat rooms and bulletin boards are not necessarily (and in some cases not at all) those of 94.3 KILO Radio. 94.3 KILO Radio is not responsible for any materials provided by users, which are deemed harmful or offensive to others. 94.3 KILO Radio is not responsible in any way for any injury, loss or damage, which occurs as a result of an opinion expressed or information, provided in these sections of the site.

e. 94.3 KILO Radio has established relationships with reputable business partners that allow visitors to our site to link directly to sites operated by these partners. Some of these sites may be branded or co-branded with a 94.3 KILO Radio logo; however, they are not operated or maintained by 94.3 KILO Radio or its affiliated companies. 94.3 KILO Radio chooses its advertisers and business partners carefully. 3. Participant's Indemnification/Obligations

Participant agrees to defend, indemnify and hold harmless 94.3 KILO Radio, its parent, subsidiary and affiliated companies and their respective directors, officers, employees and agents from and against all claims, losses, costs and expenses (including attorney's fees) arising out of Participant's use of 94.3 KILO Radio sites, or arising out of any violation of these Rules of Conduct by Participant including, without limitation, any communication by Participant which is claimed to be defamatory, obscene or otherwise unlawful, which is claimed to violate the copyright, trademark, proprietary or other rights of third parties, or which constitutes a submission of materials.

4. Termination

94.3 KILO Radio shall have the right to immediately terminate any Participant's use of the 94.3 KILO Radio site if 94.3 KILO Radio determines in its sole discretion that Participant has violated the Rules of Conduct set forth herein or otherwise breached this agreement, or has engaged in conduct which 94.3 KILO Radio determines in its sole discretion to be unacceptable.
